Welcome to Chocolatey AI ("Service"), an AI platform developed and operated by Chocolatey AI ("we," "us," or "our"). Chocolatey AI leverages various AI models and technologies, including but not limited to Claude, OpenAI and Deepseek, to provide automated responses to user queries and facilitate interactive discussions. By accessing or using Chocolatey AI, you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not access or use Chocolatey AI.

1. Acceptance of Terms

By accessing or using Chocolatey AI, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws. If you do not agree, you should immediately stop using the Service.

By submitting or transmitting any content ("User Content") to Chocolatey AI, you grant Chocolatey AI a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to store, display, process, and use your User Content in any way deemed fit by Chocolatey AI. 3. Trademarks. All trademarks, service marks, logos, trade names, and any other proprietary designations belonging to Chocolatey AI used herein are trademarks of Chocolatey AI.

6. Modifications to the Terms

We reserve the right, in our sole discretion, to change, modify, or update these Terms at any time. When we do, we will notify you of the updated Terms through various means, including but not limited to the website, email, text, or within the Service, and update the "Last Updated" date at the top of this page. Your continued use of Chocolatey AI after any such changes constitutes your acceptance of the revised Terms.

7. Disclaimers & Limitation of Liability

To the fullest extent permitted by applicable law: The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not guarantee 100% uptime, accuracy, or reliability of AI-generated outputs. Chocolatey AI is not liable for any damages caused or related to the use of the Service. Chocolatey AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of Chocolatey AI. We shall not be liable for any damages arising from the use or inability to use the Service.

8. Indemnification

You agree to indemnify and hold harmless Chocolatey AI, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising out of or in any way connected with: Chocolatey AI and its subsidiaries.

Chocolatey AI may integrate, incorporate, or otherwise link to third-party services or content. We do not endorse or assume responsibility for such third-party services. Your interactions with these third-party services are governed by their own terms and policies.

10. Payment and Refunds

Chocolatey AI does not provide refunds for any purchases. All purchases are final. All payments and purchases are processed through Stripe. You are responsible for any applicable taxes, and we reserve the right to change our pricing at any time with notice.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason including, but not limited to, breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us or through your account settings.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Chocolatey AI operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

13. Export Restrictions

You agree to comply with all applicable export and re-export control laws and regulations. You may not use the Service in violation of any export restrictions or embargoes imposed by any applicable jurisdiction.
